These Terms are between you and Nikolai Iakubovskii, Calle Emilio Tuya, 37, Gijon, Asturias 33202, Spain ("we", "us", or "our"). By using TanPilot, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use TanPilot. If you are aged 13 to 16 and located in the EU, your parent or legal guardian must consent to your use of the Service.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use TanPilot for personal, non-commercial purposes, subject to these Terms.
You agree not to:
- Copy, modify, reverse engineer, or decompile the Service except where law permits.
- Use automation, scraping, bots, or abuse tools against the website, app, or UV proxy.
- Attempt to gain unauthorized access to systems, accounts, data, or infrastructure.
- Use TanPilot for commercial resale, medical diagnosis, emergency response, or regulated advice.
- Submit abusive, illegal, misleading, or infringing content in support or feedback channels.
Sun, UV, and Health Disclaimer
TanPilot provides educational planning information. UV forecasts, tanning windows, burn-risk estimates, SPF reminders, Fitzpatrick skin type guidance, Vitamin D estimates, and sun exposure calculations are estimates only. They are not medical advice, diagnosis, treatment, or a guarantee that tanning or sun exposure is safe.
UV exposure can cause sunburn, premature skin aging, eye damage, and skin cancer. You are responsible for using sun protection, reading sunscreen labels, following medical advice, and seeking professional care for health concerns, medication photosensitivity, severe sunburn, or skin changes.
Forecast and Data Availability
UV, weather, cloud, location, and timing data may be delayed, unavailable, inaccurate, or affected by local conditions such as altitude, reflection, shade, buildings, water, snow, and cloud variability. Do not rely on TanPilot as your only source of safety information.
Subscriptions and In-App Purchases
TanPilot may offer optional premium subscriptions or in-app purchases. Prices, trial terms, renewal periods, and included features are displayed in the app before purchase.
- Subscriptions renew automatically unless canceled before the end of the current period.
- Charges are processed by Apple App Store or Google Play, not directly by TanPilot.
- Cancellation takes effect at the end of the paid period unless store rules say otherwise.
- Refund requests must be submitted to the relevant app store.
EU Right of Withdrawal
If you are located in the EU, consumer rules may provide a withdrawal right for digital content. By purchasing and using digital content immediately, you may acknowledge that the content is delivered right away and that the withdrawal right may be limited according to applicable law and app store rules.
Intellectual Property
TanPilot, the website, app design, text, graphics, software, and related materials are owned by us or our licensors. You do not receive ownership rights by using the Service.
Updates and Changes
We may update, suspend, or discontinue parts of the Service at any time. We may require you to update the app to keep using certain features.
Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of accuracy, reliability, availability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, punitive, or similar damages, including loss of data, loss of profits, health-related outcomes, missed reminders, or reliance on forecast estimates.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or statutory consumer rights.
Governing Law and Disputes
These Terms are governed by the laws of Spain. Disputes are subject to the courts of Gijon, Asturias, Spain, except that EU consumers may also bring proceedings in their country of residence where required by law.
EU consumers may use the European Commission Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
Changes to These Terms
We may update these Terms. Material changes may be announced on the website, in the app, or by email where appropriate. Continued use after the effective date means you accept the updated Terms.
